The "WIN A WINE TRIP TO MADEIRA" contest is organized by Via FAOC s.r.o., located at Zamenhofova 440, 108 00 Prague, Company ID: 022 14 041, registered in the Commercial Register kept by the Municipal Court in Prague, File No. C 216782 (hereinafter referred to as the “Organizer”). The contest starts on June 1, 2024, and ends on June 30, 2024.
2. Participation Conditions
All individuals may participate in the contest provided that: (i) they are authorized to travel from their country to the destination – Madeira, (ii) they are at least 18 years old, and (iii) they participate as private individuals.
3. Valid Email Address and Membership in the Fashion Club
Registrations with an invalid email address will be rejected.
To participate in the contest, the participant must be an individual and a member of the Fashion Club who has subscribed to marketing communications.
4. Prizes
4.1. Prizes to be won:
4.1.1. FIRST PRIZE: A wine trip to Madeira for 2 people from September 19, 2024, to September 26, 2024. The Organizer is not a travel agency and does not organize or arrange the trip, but will assist with communication and administration if necessary for the prize transfer. The trip is organized by the contest partner, travel agency Blue Style a.s., Jindřišská 873/27, 110 00 Prague 1, Company ID: 256 09 688, registered in the Commercial Register kept by the Municipal Court in Prague, Section B, Insert 26756 (“Trip Organizer”). The Trip Organizer will provide all necessary information about the prize directly to the winner. For the purpose of this contest, this prize includes:
- A round-trip ticket departing from Prague on September 19, 2024, and returning to Prague on September 26, 2024;
- Accommodation at Hotel Duas Torres 4* in Madeira (7 nights with half board for 2 people);
- Car rental of category C (Nissan Note/Renault Clio IV) for the duration of the trip, with the winner needing to provide their credit card (not debit), and this car can only be picked up and returned at the specified hotel.
For the avoidance of doubt, like a regular purchased trip, some elements of this prize can only be utilized under prescribed conditions, which the Trip Organizer will inform the winner about. The Organizer bears no responsibility and does not guarantee the possibility of using the trip and its elements if these conditions are not met. This may include airport rules, airline rules, a driving license for car rental, or providing a refundable deposit by credit card, etc.
4.1.2. SECOND PRIZE: A gift card for the Fashion Arena Prague Outlet worth 5,000 CZK, subject to its own terms and conditions available at https://www.fashion-arena.cz/darkova-karta.
4.1.3. THIRD PRIZE: A gift card for the Fashion Arena Prague Outlet worth 3,000 CZK, subject to its own terms and conditions available at https://www.fashion-arena.cz/darkova-karta.
4.2. Notwithstanding Article 10, the Organizer may substitute any prize with a cash alternative.
5. Prize Collection Conditions
5.1. The FIRST PRIZE must be used within the trip dates provided by the Trip Organizer.
5.2. The winner of the prize will bear all costs not expressly stated in these terms in Article 4, and any queries regarding individual costs will be answered directly by the Trip Organizer. For clarification, some expenses not included in the FIRST PRIZE are:
5.2.1. Traveling in business/first class;
5.2.2. Personal travel and health insurance;
5.2.3. Transfers to the departure airport (Prague) and their costs;
5.2.4. Private expenses; or
5.2.5. Financial means and/or necessary financial minimum.
6. Contest Participation Requirements
6.1. To participate in the contest, you need to visit the center from June 1, 2024, to June 30, 2024, make a transaction, and use the Fashion Club card during this transaction. If you qualify for this contest, we will send you a link to express your consent to participate in this contest and agree to these terms and conditions.
6.2. Each participant may only participate in this contest once and only under the conditions of these terms and conditions. Multiple entries are not allowed, and if such a situation arises, only the last entry will be valid.
6.3. The email used in the contest must match the email used in the Fashion Club membership when making the transaction.
7. Winners
7.1. The winner of the FIRST PRIZE stated in point 4 will be the participant who meets the participation requirements according to point 6 above and fulfills all other requirements of these conditions (“eligible participant”), and who will be drawn by the Organizer from all other participants who met the above conditions.
7.2. The winner of the SECOND PRIZE will be the eligible participant drawn from other eligible participants who are not the winners of the FIRST PRIZE.
7.3. The winner of the THIRD PRIZE will be the eligible participant drawn from other eligible participants who are not winners of the FIRST or SECOND PRIZE.
7.4. Winners will receive an email from the Organizer (and/or the Organizer will call the winner if a phone number is available) after the Organizer decides on the winner.
7.5. The Trip Organizer is the contest partner of the Organizer providing the FIRST PRIZE, and the winner of the FIRST PRIZE must collect it from the Trip Organizer according to point 7.6 below to become the trip orderer and for the FIRST PRIZE to be provided.
7.6. Winners must collect their prize no later than 10 working days after the prize notification from the Organizer according to point 7.4 above. For the FIRST PRIZE, collecting it means informing the Trip Organizer by email to the email address provided by the Organizer when notifying the win. If the winner does not collect their prize by this date, it will be forfeited. The Organizer will be entitled to select a new winner from the remaining eligible participants who have not yet received a prize if it so decides.
7.7. Winners may be required to pay any taxes that are or may be assessed on the prize value according to legal regulations. The Organizer disclaims any responsibility in this regard.
8. Fraudulent Behavior
Any attempt at fraud will lead to the immediate disqualification of the participant. This provision will take precedence over the provision in Article 6.2. Identification data must correspond to the name used when registering for the Fashion Club program (see Article 6). Otherwise, the participant will be immediately disqualified.
9. Prohibition of Resale
Resale of prizes is strictly prohibited.
The FIRST PRIZE can only be used by the Fashion Club member who is its winner and their chosen companion. The winner is fully responsible for selecting the person who will accompany them. No prize may be resold to any third party.
Violation of this provision will result in the immediate disqualification of the participant from the contest and the forfeiture of any winnings.
10. Non-Transferability
Prizes are personal and non-transferable. The winner cannot exchange prizes in any way.
11. Non-Compliance with Rules
If winners do not meet the criteria set out in these rules, the prize will not be awarded and will remain the property of the Organizer.
12. Publication of Winner's Details and Copyright
12.1. The Organizer reserves the right to publish the names and photos of the winners and their prizes on the fashion-arena.cz website and Fashion Arena Prague Outlet social media - Facebook, Instagram, and LinkedIn - as well as on any other commercial or promotional materials, without any compensation to the winners. By participating in the contest, participants expressly agree to the publication of their data.
12.2. Each participant: (i) acknowledges that the copyrights to the submitted materials will be owned by the Organizer; and (ii) waives all moral rights to the submitted materials.
13. Identity Verification
Participants agree to verify their identity and match the country of residence provided with their ID card. If a participant provides incorrect identity or address, they will be immediately disqualified from the contest.
14. Internet
14.1. Participation in the contest requires knowledge and understanding of the characteristics and limitations of the internet, especially regarding technical performance, the risk of service interruption, and the general risks associated with any connection and transmission over the internet, the absence of protection of some data against potential attacks, and the risk of network infection by viruses.
14.2. The Organizer bears no responsibility for internet transmissions, internet and/or software failures, consequences of viruses, bugs, anomalies, and technical faults; and any technical, hardware, or software malfunctions of any kind.
15. Responsibility
15.1. The Organizer bears no responsibility for any direct or indirect damages arising from interruptions, failures, participant exclusions, or termination of the contest for any reason. The Organizer also bears no responsibility for any direct or indirect damages that may arise from connecting to these websites.
15.2. The Organizer bears no responsibility for unclaimed prizes or damages and/or injuries caused to any person when using the prize unless the damages and/or injuries were caused by the Organizer's breach of legal duties.
15.3. The Organizer bears no responsibility for the cancellation or delay in the collection or use of the prize, which was not directly caused by the Organizer.
15.4. Each participant must take all necessary measures to secure their data and/or software on their computer (including tablets) and/or mobile phone and/or on their site against any attack.
15.5. Participants are solely responsible for connecting to the Organizer’s websites and participating in the contest. The Organizer is also not liable if the contest needs to be changed, shortened, or canceled due to force majeure or reasons beyond its control.
15.6. The Organizer reserves the right to verify compliance with these terms and to disqualify any participant who abuses these terms against their intended purpose.
16. Force Majeure
During the contest, the Organizer may publish any amendments to the contest terms or make changes in the event of force majeure. These changes and amendments will be considered an appendix to these Terms.
17. Changes and/or Cancellation of the Contest
17.1. The Organizer reserves the right to change, extend, or even completely cancel the contest in extreme cases due to events entirely beyond its control. The Organizer is not liable if the contest needs to be interrupted, postponed, or even canceled for reasons beyond its control.
17.2. The Organizer’s decision is final on all matters not explicitly stated in these terms.
17.3. If for any reason it is not possible to properly utilize the FIRST PRIZE, and this fact is not caused by the winner’s fault (e.g., flight delay and/or the winner is not allowed to board the plane for any reason), please contact the Organizer or potentially at [email protected]. The Organizer will attempt to resolve the situation if possible and within its power (the Organizer is not a travel agency that organizes the trip).
18. Acceptance of the Terms
By participating in this contest, the participant confirms that they agree to these terms.
19. Data Protection
19.1. Unless the participant objects, the Organizer will store the data provided by the participant during registration in its database.
19.2. The Organizer is committed to protecting the privacy of participants. The Organizer uses your personal data only in accordance with applicable data protection laws. The Privacy Policy available at https://fashion-arena.cz/ochrana-osobnich-udaju also applies to this contest. It explains how we collect and process your personal data, not only in the context of this contest.
19.3. The Organizer explicitly references the Cookie Policy available at https://fashion-arena.cz/zasady-pro-soubory-cookie for information on the use of cookies, and the Website Terms of Use available at https://fashion-arena.cz/obchodni-podminky for operating the fashion-arena.cz website and the conditions under which it can be visited and used.
19.4. By participating in this contest, the participant agrees, unless otherwise stated, that the Organizer collects and uses their personal data in accordance with the Organizer’s Privacy Policy (https://fashion-arena.cz/ochrana-osobnich-udaju).
20. Communication
20.1. We will contact you by email (and potentially by phone) based on the contact information you provided.
20.2. If you no longer wish to receive our communications, want to cancel your participation in this contest, or inform us of changes to your personal data, please let us know by emailing us at [email protected].
21. Governing Law
The terms are governed by Czech law and are subject to the exclusive jurisdiction of the courts of the Czech Republic.
